“Equipment” - means the Equipment (including any parts for them)
specifically stated in the Order Confirmation.
“Hirer” - means the person or business placing an order for any
equipment with Networks Inc..
“Rental Period” - means the period commencing on the date of
delivery as specified in the Order Confirmation until the return
date or unless terminated in accordance with these terms.
“Networks Inc.” - means Networks Inc. Ltd (registered number
4464163)
“Order Confirmation” - means an order confirmation from Networks
Inc. confirming receipt of the Hirer’s payment
“Writing” - and any similar expression, includes facsimile
transmission, e-mail and comparable means of communication.
“Website” - means the website for the rental of the Equipment at
www.networksinc.co.uk
“Contract” - means the contract for the supply and rental of the
Equipment.
“Terms” – means the standard terms of rental and supply of the
Equipment set out in this document and includes any special terms
agreed in Writing between the Hirer and Networks Inc..
Rental Period
The Rental Period will be from one month upwards. There is a minimum
charge of one month for certain products up to and including the
first seven days. For every incomplete week thereafter a daily rate
will apply up to a further six days.
Payment
Payment is taken immediately for the Rental Period if booked online
or over the telephone by credit or debit card. Payment can be made
in UK Sterling only. The Rental Charges are exclusive of
transportation from the Hirer’s premises. An Order Confirmation will
be sent following payment.
Insurance
The Hirer is responsible for ensuring the premises the equipment is
kept in is covered by sufficient contents insurance. If the
equipment is lost or stolen the Hirer is responsible for paying for
the replacement of the equipment.
Deposit
The Hirer will be required to leave a security deposit one working
day prior to the commencing day of hire. Networks Inc. will
automatically secure the deposit on the same credit/debit card used
for payment unless advised otherwise. In the event that your
credit/debit card fails and we are unable to contact you or you are
unable to provide an alternative credit/debit card to process the
transaction your reservation will be cancelled and a cancellation
charge will apply. Please see cancellation charges for further
information. Any loss, damage, cancellations or late returned
equipment will be subtracted from the deposit and the balance of the
deposit will be returned to the customer.
Start and End of
Rental Period
The Rental Period starts on the day the Equipment is delivered to
the hirer’s offered delivery address. End of Rental Period is the
day the unit is handed to the Post Office for Royal Mail Special
Delivery next day by 1pm. Late returns are payable at £20.00 + VAT a
day and will be taken from your deposit. If the product is returned
with missing component/s then the customer is liable for a late
return payment until the missing component/s is/are returned.
Force Majeure
Networks Inc. reserves the right to defer the date of delivery or to
cancel if it is prevented from or delayed in the carrying on of its
business due to circumstances beyond the reasonable control of the
company including, without limitation, acts of God, governmental
actions, war or national emergency, acts of terrorism, protests,
riot, civil commotion, fire, explosion, flood, epidemic, lock-outs,
strikes or other labour disputes, or restraints or delays affecting
couriers or inability or delay in obtaining equipment.
Faulty/Incomplete Equipment
All Equipment is checked prior to dispatch. The Hirer is to inspect
the equipment upon delivery and notify Networks Inc. immediately in
writing of any defect. If no such notification is given then it will
be presumed that the equipment was delivered in complete, good and
working order and fit for it’s purpose as required.
Transportation
The cost of hire includes delivery to your chosen address. It is
your responsibility to collect and return the equipment where
applicable and within the stated time period. Late charges will
apply at £20 + VAT per day. We send all products via Royal Mail
Special Delivery next day and the Equipment must be returned using
the same Service.
Equipment Loss
or Damage
The Hirer will observe and adhere to all the instructions relating
to the correct use of the Equipment and keep the Equipment in good
condition. The Hirer will be held entirely responsible for any
subsequent loss or damage to the equipment resulting in failure to
observe such instructions, or failure to use the equipment in a
proper manner. The Hirer will be responsible for the replacement
cost of any damaged or lost components of the unit or any repair.
Networks Inc. accepts no responsibility or liability for any damage
to or failure of operation of the Equipment due to any
incompatibility with any other Equipment used by the Hirer and the
Hirer will be liable in this instance. Networks Inc. undertake to
report the damage to the Hirer within 24-hours of its arrival back
to it’s premises.
Equipment
Failure
In the event of any failure of the Equipment the Hirer shall
immediately provide Networks Inc. with a written notice specifying
the failure. Should the Equipment failure prove to be due to misuse
or the fault of the Hirer in any way, Networks Inc. reserves the
right to pass on the costs of repair charges to the Hirer.
Packaging
Our packaging is proven to ensure safe delivery of any product we
hire out. All equipment should be returned as you receive it. If the
packaging is damaged in anyway or lost the Hirer will be charged
£10.00 + VAT to cover the replacement of the packaging.
Non Return of
Equipment
The Hirer will be responsible for the safe return of the unit and
all its component parts. The Hirer will be responsible for hire cost
until such time as the unit and/or any missing components are
returned at the rate of £20.00 + VAT a day.
Distance Selling
This relates to those matters required by the EC Directive on
Distance Selling as ratified by the Consumer Protection Regulations
2000 which applies where the Contract is entered into through the
Website.
Identity –
The supplier of any Equipment purchased to these Terms is: Networks
Inc. Ltd (Company No. 4464163) whose registered office is at
Midsummer Court, 314 Midsummer Blvd, Milton Keynes MK9 2UB.
Description of Goods – The Equipment supplied and leased to
these Terms comprise Equipment selected from those available on our
Website.
Price – The price of Equipment supplied and leased via the
Website shall be the price advertised on the Website together with
Value Added Tax.
Delivery Costs – Equipment may be delivered directly to your
premises at an additional cost specified on the Website.
Payment – Payment for the Equipment supplied to these Terms
must be made on order and payment will be confirmed on the Order
Confirmation.
Cancellation - A Cancellation charge will apply to any
booking the Hirer is unable to honour prior to the commencement of
the Rental Period. All cancellations must be made in Writing and
will take effect from the date received by us.
Refunds given for cancellation are as follows:
0-3 days prior to Rental Period – 0% of Rental Charge
4-6 days prior to Rental Period – 50% of Rental Charge
7+ days prior to Rental Period – 100% of Rental Charge
No refund given for rental ended early or cancellation made after
the commencement of the Rental Period.
Cost of Communicating with Networks Inc. – There are no
premium rate charges which the Hirer will be charged by reason of
communicating with Networks Inc.. The cost of any such communication
will be limited to the charges you would normally incur for the use
of the internet as per your personal arrangements with your internet
service provider and your telephone company.
Price Validity
– The price for the lease of the Equipment is fixed at the date of
hire. Future hire of the Equipment may be subject to the prevailing
prices of the time.
Duration of Contract – The period of the hire agreement shall be
specified in the Order Confirmation.
By placing an order to hire our equipment you are agreeing to the
terms and conditions laid out. Contracts do not affect your
statutory rights.
